Totalitarian governments are always attempting to blur the line between legal and illegal actions. The current efforts by Democratic district attorneys and the Justice Department to indict former President Donald Trump (and some of his associates) involve convincing grand juries that Mr. Trump “tried to” do various illegal things. These actions include overturning election results and inciting insurrections.

But determining what someone is “trying” to do is often in the eyes of the beholder. What the Democrats call “trying to overturn an election” the Republicans might call “trying to ensure that election results are valid.”
